Ditto to what Jerry said. Dimitry you are generous to a fault. Thank you for you work, your music and your spirit.I don't think Dimitry did anything consciously wrong, and I admire his dedication to being part of this great community. He reacted honorably and should still be applauded for working so hard to help everyone (for no personal gain). Lesson learned/move on.

I totally agree with all, what Waveform and jerrythek said above.
I am sure Dmitriy had good intentions. First everyone seemed to applaud his work, even wanted to pay him, but he did not want any money.
If we will dig dipper in this "sample" absurd, we will probably not be able to record any song, cause we could violate somebody rights to something.
Regards
Mike

Obviously it's allowed to record and make a CD with the Kronos or any other musical instrument in the world, commercially or non commercially..Jens wrote: Unless you are allowed to to so, it would be illegal, yes. But fortunately, according to the license agreement, this kind of use (recordings of music involving those samples) is permitted by a statement of the copyright owner - at least for non-commercial use.
What is not allowed is to sample for instace Omnisphere to make new playable sounds and spread them.

hehehe of course not.Sparker wrote:Does that mean Qui's Omnisphere Tutorial is under suspicion? What is not allowed is to sample for instace Omnisphere to make new playable sounds and spread them.
It's just an example of sampling things and transfer that to the kronos.
I never shared a preset with the community based on those samples. Actually i never stored that sample on my kronos, it was just for demoing purposes.
But with omniphere you are not allowed to use single notes in your own music. Due to the risk that people can sample it. That's why during the creation stage of the samples you hear a background track instead of omnisphere.
To be honest, i think a lot of people are overreacting in this thread. Of course nobody should share commercial libraries where they don't own the rights to it. Nobody cares if you sample a motif XS or XF in your own studio and use a couple of those sounds in the Kronos for your own purpose. You've bought both machines so that should be fine. But if you share those sounds then that's possible where someone can cross the line.
So ease up guys, these kind of sampling possibilities are available since years, this is nothing new. The only thing new is that we can create larger sample libraries with less memory needed in a hardware synth. But the discussion about cloning, modifying and deploying isn't a new one.
But in my opinion when everyone uses their own moral compass then they will know what's acceptable and what's not.

Not exactly on yours... They are putting limits on your use of THEIR creations.BasariStudios wrote:Spectrasonic are the most ridiculous, in their rights states that you cant use

They have morally as well as juristically the right to do this. They grant you rights you don't naturally own - namely to use their samples. They grant you this permission under certain restrictions. If you don't agree their terms, you are free not to use their samples at all.
That does not put any restriction on your creation. You only have to create our own samples to realise them...

I read the Spectrasonics license. They don't allow you to resample their sample packs and redistribute them (subtext: as playable samples). They clearly allow you to use their samples as part of your musical creations:BasariStudios wrote:Yes Jens...but i found nice Strings in Omnisphere...and i wanna start a song

...but not more.Use of these sounds in Multimedia/Game Music projects is limited to use within original musical compositions.
Where is there any restriction regarding your muscial work? I can't even find a passus which would not allow you to use single notes. The only thing they forbid is to make a collection of samples (subtext: each single sample accessible - or the vast majority of single samples - without background noise) and redistribute it. I can't see where they would prohibit you from using, let's say, a single long note alone in the beginnig of your song - because it's only one.
Maybe, if you make a CD with 88 tracks containing a very short composition each, and every single song begins with a different single note of the same instrument, MAYBE that would become critical. But that is rather academic.
I agree to Qui: calm down, use your moral compass and you will find out. For those who don't have any morals, well...
Jens
PS: I've read this kind of discussions many times. And sometimes I can't believe that musicians, artists, are talking that way over other artists hard work...

I realize it's a slippery slope ... and I don't want to beat a dead horse either ... but I believe I saw a comment Sharp made in another thread that still rings true in my mind. As much as I love Spectrasonics (I own Ominsphere and plan to purchase Stylus RMS and Trilian at some point) and have the utmost respect for Eric Persing's work ... Eric built Spectrasonics on sampling. Some of the samples are original, some are from his older collections, but at the end of the day Spectrasonics has Mellotron samples in their products too. If by definition you are saying that is wrong, then that makes Spectrasonics, Native Instruments, IK Multimedia, etc. ALL guilty of copyright violations. How can you hold end-users accountable for not copying other peoples samples when software companies do it all the time? I still don't understand the logic behind "it's okay to sample a vintage keyboard but not a Motif."
On a similar vein, I record a CD which uses KARMA GE's. Am I violating copyright because Stephen Kay created KARMA? Do I need to credit his work and contribution to my recordings? I'll be happy to oblige if need be but if I download the Assault package that James did and is sold on Korg's site, can I not use those Combis in my music? Or is this a violation as well. Just needing some clarification here. And I realize copyrights are different around the world. I'm in the US so how does this all apply to me?

I'm pretty sure it's alright to sample a Motif. You bought the rights to use the keyboard for commercial work. It's NOT alright to use Yamaha or Motif in the name of your sample collection, as they are registered trademarks. It's also not alright to hack the Motif to read and copy the actual sample waves and redistribute those.
